These Affiliate Program Terms and Conditions (“Agreement”) govern your participation in the GreenStar Ontario Affiliate Program (“Program”) operated by GreenStar Ontario (“Company”, “we”, “us”, or “our”). By signing up or participating in the Program, you (“Affiliate”, “you”, or “your”) agree to be bound by this Agreement.

1. Enrollment in the Program

To enroll, you must complete the Affiliate application form. We reserve the right to accept or reject any application at our sole discretion. If accepted, you will receive access to a unique referral link and promotional materials.

2. Affiliate Responsibilities

As an Affiliate, you agree to:

  • Promote GreenStar Ontario products and services in a lawful, ethical, and positive manner.
  • Ensure that all claims about GreenStar Ontario are truthful and not misleading.
  • Not use spam, false advertising, or deceptive practices to promote links.
  • Comply with all applicable Canadian laws and regulations, including the Competition Act, PIPEDA, and anti-spam legislation (CASL).

3. Affiliate Links and Tracking

You will be provided with a unique tracking ID to use in your affiliate links. Sales are tracked through cookies valid for [e.g., 30 days]. If a user clears cookies or uses another device, the sale may not be tracked.

4. Commissions and Payments

  • Commission Rate: Affiliates earn a [insert percentage or flat amount] for each qualified sale made through their unique link.
  • Qualified Sale: A completed purchase that is not refunded within [e.g., 30] days.
  • Payments: Commissions are paid monthly, on or around the 15th of the following month, via [e.g., PayPal, bank transfer].
  • Minimum Payout Threshold: $[insert amount], unless otherwise agreed.
  • Taxes: You are responsible for any taxes due on your earnings.

5. Prohibited Activities

You may not:

  • Use paid ads (e.g., Google Ads, Facebook Ads) that directly compete with our own.
  • Use “GreenStar Ontario” or misspelled variants in domain names.
  • Present yourself as an employee or representative of GreenStar Ontario.
  • Promote your affiliate link using spam emails or unsolicited messages.
  • Promote on sites containing hate, violence, adult content, or illegal material.

Violation of these rules may result in termination and forfeiture of commissions.

6. Intellectual Property

You are granted a non-exclusive, non-transferable license to use our logos, banners, and content solely for the purpose of promoting GreenStar Ontario. You may not modify our materials without written permission.

7. Term and Termination

This Agreement begins upon your acceptance and continues until terminated. Either party may terminate this Agreement at any time, with or without cause, by providing written notice.

Upon termination:

  • You must stop using all promotional materials and remove affiliate links.
  • Accrued commissions on qualified sales will be paid on the next payment cycle unless terminated due to violation of terms.

8. Limitation of Liability

We are not liable for indirect, special, or consequential damages (loss of revenue, profits, data) in connection with this Program. Our total liability will not exceed the total commissions paid to you in the last 3 months.

9. Modification of Terms

We may update these terms at any time by posting a revised version on our website. Continued participation after changes implies your acceptance of the revised terms.

10. Governing Law

This Agreement shall be governed by and construed under the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts located in Ontario, Canada.
